Terms of Service

These Terms govern your use of the websites, software, and subscription services provided by 5StarsDesigns ("5StarsDesigns," "we," "us," "our") to you ("Customer," "you," "your"). By signing up or paying for any plan, you agree to these Terms.

1. Service

5StarsDesigns provides mobile-first website design, hosting, maintenance, and related marketing services for US home-service businesses on a subscription basis. The specific deliverables, page allowances, and features included with each plan are listed on our pricing page and may be updated from time to time. We reserve the right to refuse service to anyone for any lawful reason.

2. Subscription, Pricing, and Billing

Our service is sold as a recurring monthly or annual subscription. Pricing is shown on our pricing page at the time of signup. Once you subscribe at a given rate, that rate is locked for the life of your subscription (the "Lifetime Price Lock"). Payments are processed via Stripe; we do not store your full card details.

  • Monthly plans are billed every month on the date you signed up.
  • Annual plans are billed upfront and renew yearly unless cancelled before the renewal date.
  • Failed payments may pause your service after a 3-day grace period.

3. Minimum Term and Cancellation

All plans require a 12-month minimum term. After month 12, you may cancel at any time with 30 days' written notice via email to hi@5starsdesign.com. If you cancel during the initial 12-month term, you remain responsible for the remaining months at your locked rate.

4. Guarantees and Refunds

We offer the guarantees described on our pricing page (free demo before payment, "Live in 7 days" or first month free, "Better than what you have or we work for free until it is"). Beyond those specific guarantees, subscription fees are non-refundable. If a payment is disputed in good faith, contact us first and we will attempt to resolve it directly.

5. Add-On Services

Additional pages beyond your plan's allowance are $100 each (one-time fee per page) and blog setup is $250 one-time (waived on the Dominance tier). Other custom work is quoted separately and billed via Stripe.

6. Content and Intellectual Property

You own all content you provide to us — copy, photos, brand assets, customer reviews. By providing it, you grant us a license to use it for the purpose of building and operating your site.

We own the underlying website framework, templates, and code we use to build sites for all clients. When your subscription ends, you retain all rights to your business name, brand, content, and the published copy on your site. We will deliver an export of your content within 30 days of cancellation, but we do not transfer our proprietary framework or codebase.

7. Hosting and Uptime

Sites are hosted on Cloudflare's global edge network. We target 99.99% uptime, but we make no guarantee of uninterrupted service. We are not liable for downtime caused by upstream providers, DNS providers, your domain registrar, force majeure events, or your account being suspended by Cloudflare or Stripe for policy violations.

8. Acceptable Use

You agree not to use the service to:

  • Host content that is illegal, infringing, defamatory, or harmful;
  • Distribute spam, malware, or phishing material;
  • Resell or sublicense our service to third parties without written consent;
  • Attempt to reverse-engineer, scrape, or interfere with our infrastructure.

We may suspend service immediately if we reasonably believe you are violating this section.

9. Communication

Day-to-day support runs through WhatsApp and live chat. We aim to respond to WhatsApp messages within four business hours and to live chat within 30 minutes during business hours (9 AM – 6 PM in your local time). We do not offer phone-call support. You may book a 1:1 video meeting via Cal.com when one is needed.

10. Third-Party Services

We integrate the following third-party services to deliver the platform:

  • Cloudflare — hosting, DNS, security, analytics
  • Stripe — billing and payment processing
  • Resend — transactional email
  • MailerLite — newsletter / marketing email
  • Cal.com — meeting scheduling
  • Google Business Profile — review management (with your authorization)

Each of these has its own terms and privacy policy that apply to your data when it is processed by them. We are not responsible for outages, errors, or policy changes by these providers.

11. Disclaimers

The service is provided "as is" and "as available." We disclaim all warranties not expressly stated in these Terms, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, secure against all attacks, or that any specific business outcome (rankings, leads, revenue) will be achieved.

12. Limitation of Liability

To the maximum extent permitted by law, 5StarsDesigns' total liability under these Terms for any cause is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages — including lost profits, lost revenue, or lost data.

13. Indemnification

You will defend, indemnify, and hold us harmless from claims, damages, and costs arising from your content, your use of the service in violation of these Terms, or your violation of any law or third-party right.

14. Termination

We may terminate or suspend your access immediately for material breach of these Terms or for non-payment. On termination, your right to use the service ends immediately. Sections 4 (Refunds), 6 (IP), 11–13 (Disclaimers, Liability, Indemnification), and 15 (Governing Law) survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to personal jurisdiction there.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to active subscribers by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
